Will Products Liability Litigation Help Protect IoT Users from Cyber-Physical Attacks?

While there is an identifiable trend towards protecting consumers from data breaches and misuses related to IoT devices through new legislation, regulations, government enforcement actions, private lawsuits, has been little progress creating similar legally enforceable standards of care for “cyber-physical device security.” This article explores this underdeveloped area academic inquiry into cyber-physical security within the context product liability litigation in United States. The two questions addressed are: (1) Have any successful products court decisions States that have held manufacturers liable with inadequate security; (2) Is it likely will soon lead significant change security? Analysis laws, cases shows answer both negative. These findings implications users, manufacturers, agencies whose job deter other IoT-related cyberattacks.
